The ACA’s Medicaid Expansion

A Review of Ineligible Enrollees and Improper Payments

Brian Blase Former Senior Research Fellow
Aaron Yelowitz Professor of Economics, University of Kentucky
Before passage of the Affordable Care Act (ACA), Medicaid covered individuals with disabilities, lower-income seniors, pregnant women, and lower-income children along with their adult caretakers. The ACA opened program eligibility to working-age, able-bodied adults with incomes up to 138 percent of the federal poverty level. It also set much higher federal reimbursement rates for state expenditures on the new enrollees so that the federal government covers nearly the entire cost.
In their new study, The ACA’s Medicaid Expansion: A Review of Ineligible Enrollees and Improper Payments,” Brian C. Blase and Aaron Yelowitz find evidence that enrollment has been much higher than expected in states that adopted the expansion, that significant errors and problems permeate state eligibility determinations for Medicaid, and that many program enrollees are ineligible. States are responsible for monitoring who enrolls in Medicaid, but the federal government foots most of the bill. Given the structure of the ACA Medicaid expansion, states have little, if any, incentive to spend wisely or to strictly follow enrollment guidelines.
The financing structure for the Medicaid expansion presents states with incentives to classify individuals—both those already eligible for Medicaid under previous criteria and those formerly ineligible for Medicaid—as newly eligible. Additionally, healthcare interest groups in the states, such as hospitals and insurers offering Medicaid managed care, generally benefit from maximizing Medicaid enrollment, particularly at the elevated rate. As these groups have significant political power in state capitols and most of the money is flowing from the federal government, the lack of program integrity from states is not surprising. The problematic incentives facing states necessitate competent and vigorous federal oversight of the program, which unfortunately has not occurred to date because the Obama administration actually canceled Medicaid eligibility reviews from fiscal years 2014 through 2017 and the Trump administration has pursued other priorities in the program.
The Medicaid Financial Structure is Broken
Evidence suggests there has been significant dysfunction and problems with Medicaid enrollment after the ACA:
  • Audits by the Department of Health and Human Services and several states have found a broken process, with eligibility rules routinely ignored and many ineligible and potentially ineligible individuals enrolled in Medicaid. In particular, audits in California, Colorado, Kentucky, and New York have shown large numbers of both ineligible and potentially ineligible Medicaid enrollees.
  • A new Centers for Medicare and Medicaid Services (CMS) audit shows significant errors in how states are reviewing and determining eligibility, with an improper payment rate likely in excess of 20 percent.
  • State audits in Louisiana and Oregon have shown a broken eligibility process, with large numbers of ineligible or potentially ineligible enrollees.
  • Substantially more working-age adults with incomes above 138 percent of the federal poverty line, particularly those who do not otherwise meet Medicaid eligibility criteria, are enrolled in Medicaid.
States are Not Properly Screening for Medicaid Eligibility
Audits by the Office of the Inspector General (OIG) at the Department of Health and Human Services found many shortcomings with states’ Medicaid eligibility processes, including the following:
  • Failing to maintain proper documentation
  • Not properly verifying income eligibility
  • Misclassifying individuals into the newly eligible category
  • Failing to properly verify citizenship
Correcting these problems would protect federal taxpayers and ensure that states are contributing their lawful required amount for Medicaid enrollees. For example, the OIG estimates that New York made federal Medicaid payments of more than $520 million on behalf of almost 400,000 ineligible beneficiaries during its six-month audit period. Fixing these problems would also ensure that resources are being used to provide services and care for the people that Medicaid was originally intended to serve.
Addressing these shortcomings would also create fairness between the states. The nine states with the largest percentage point change in Medicaid enrollment of adults with income above 138 percent of the federal poverty level (New Mexico, California, Kentucky, Rhode Island, West Virginia, Oregon, Washington, Arkansas, and Colorado)(6 out of 8 Democratic states) all experienced a more than doubling of the percentage of this group enrolled in Medicaid. There are some areas, such as New York City and Los Angeles, where the problem is so egregious that it may be a sign of purposeful abuse of the program rules and potentially of fraud.
A few Medicaid expansion states, such as Delaware, Hawaii, Indiana, Iowa, and New Hampshire, appeared to do a reasonable job of avoiding improper Medicaid enrollment.
Four Key Recommendations
1) Congress should reform Medicaid financing so that states have better incentives to obtain value from program expenditures, by making fixed payments to states rather than open-ended reimbursements and by equalizing the reimbursement rate between traditional Medicaid populations and the expansion group.
2) CMS (on behalf of federal taxpayers) should recover costs that have been improperly claimed.
3) CMS should target states and regions with particularly egregious abuses of the system for immediate eligibility redeterminations.
4) The Congressional Budget Office should evaluate why initial cost estimates were so inaccurate and work to more accurately model the Medicaid expansion going forward.

Introduction to Q ANON by Dustin Newsom 11/26/2019

Q ANON: AND INVITATION TO THE GREAT AWAKENING.
If you value the truth, you will want to learn about the Q Anon movement and the battle that is being waged on your behalf to protect you and your children from abuse and enslavement. The war between Good and Evil is no longer merely symbolic. Evil is being, tried and brought to justice in federal courts and military tribunals today. Criminally corrupt government leaders, celebrities, religious leaders, media figures, and corporate heads will be tried and punished for crimes involving treason, human trafficking, ritual sacrifice and unspeakable perversions.

Maryland Sanctuary Counties to Free Accused Illegal Alien Child Rapists, Murderers, Child Abusers
Prince George County

Maryland sanctuary counties are expected to release into the United States six illegal aliens accused of child rape, assault, murder, and child abuse, federal immigration officials say.

The sanctuary counties of Prince George County, Maryland, and Montgomery County, Maryland, may soon release six illegal aliens who are accused of a number of violent crimes against children and American citizens, according to Immigration and Customs Enforcement (ICE) officials.
Jaycob Kidlat, an illegal alien, has been charged with five counts of sexual abuse of a minor, rape of a child under the age of 14-years-old, and third-degree sexual offense. ICE placed a detainer on him in June and it is unclear when he will be released, and if he will be freed rather than turned over to federal agents.
Illegal alien Luis Miguel Cabrera was arrested in September 2018 in one of the two sanctuary counties on charges of child abuse resulting in the death of the child, child sex abuse, and rape of a child under the age of 14. ICE has placed a detainer on him.
Illegal aliens Jaun Rivas-Montano and Manuel Carballos-Morales were both arrested this year on charges such as child sex abuse, child abuse, child molestation, and second-degree child abuse. Both have ICE detainers, but their release dates by the sanctuary counties are unknown.
Illegal alien Mouhamadou Yatassaye was arrested by Montgomery County officials in April and charged with first-degree assault. He faces up to 25 years in prison if convicted, though ICE is unaware of when and if he will be released before trial.
“The county leadership has chosen misguided politics over public safety,” Baltimore, Maryland, ICE official Francisco Madrigal said in a statement. “The individuals we have lodged detainers against have been arrested in the community and will likely be released directly back into that community under these dangerous policies.”
“We aren’t asking Montgomery County or Prince George’s County to conduct immigration enforcement, we’re asking them to honor a lawful request to transfer these individuals into our custody where they can avail themselves of due process in the immigration court system,” Madrigal said.
In May, Prince George County officials defended their release of two illegal alien MS-13 gang members who were not turned over to ICE, and thus freed into the general public. After their release, they allegedly murdered a 14-year-old girl by beating her to death with baseball bats, and stabbing her with a machete.

AMERICAN THINKER – DEMOCRATS IN A QUANDARY ON IMPEACHMENT!

Democrats Ponder Impeachment Pivot

The Democrats have twisted themselves into a Schiffian Knot, a modern-day unsolvable puzzle.
When they plunged forward on their ill-fated impeachment voyage, they were destined to land on this surreal shore, even if their parade of bureaucratic interagency cheerleaders was even weaker than presumed.
So they are in the bad place that can’t be washed away with a few margaritas. They desperately want to impeach President Donald Trump, but they don’t want to send this partisan presumption pile over to the Senate, where they can no longer control the list of witnesses, where hearsay will be inadmissible, and where narrative control swings to the Republicans.
But if they don’t impeach, their pitchfork-wielding base’s fury will reach apocalyptic levels. Nancy Pelosi, like the apostle Peter near the end of his life, was led by others to where she did not want to go. She must be furious with her caustic clown caucus that maneuvered her into such an untenable position.
I knew that Democrats were in deep trouble when my teenage daughter asked me to explain the current impeachment effort at the dinner table. She ended the conversation with this: “This is so dumb.”
In those four words, my teenage daughter found more wisdom than is being offered by any of the Democrats or the foolish Noonan Trumpers, who want all Americans to believe that this is the worst scandal in history. The attempted and ongoing coup by the Democrat-media-bureaucratic state complex may indeed be the worst scandal in U.S. history, but that’s not what they mean.
One of the most foolish takes was by the unintentionally comical Allahpundit over on Hotair. One of his recurring themes is that the president is depressed because he will be impeached by the House.
The president is practically begging the Democrats to do something so foolish. Oh, please, Schiffty and Nancy, please don’t throw me into the Senate patch.
“It would be the biggest debacle in recent political history for Pelosi to go through all this, produce evidence that her own party finds extremely compelling, and then lose the big impeachment vote,” wrote Allahpundit. That seemed to be the consensus among Never Trumps, who almost seem to relish the thought of impeachment more than Democrats.
Perhaps, but I’m skeptical. First, the Democrats know they don’t have anything compelling, which is why they can’t even peel off a single vulnerable Republican. When you’re losing even Vanity Fair, your case is in trouble.
The biggest debacle would be to actually vote for impeachment with zero Republican support. It’s a double-edged mistake in that it forces vulnerable Democrat members to sign their political death certificates in a vanity vote while sending this to the Senate, where real sharks are circling.
Pelosi can almost certainly get 218 votes, although she will likely lose a few Democrats in the process. But will she ignore her political instincts and follow that path?
The Republicans in the House did a superb job in shredding the wet noodle projectionist Democrat project under the worst possible conditions. And while I have more confidence in rising Republican superstar Elise Stefanik and the rest of her Republican colleagues in the House than in some of their Senate colleagues, the ground will be way too favorable in the Senate for this to be anything but a Democrat Chernobyl.
Democrats and their media allies would be forced to watch in abject misery as Republicans call witnesses like the Bidens and Schiffty and focus on revealing the origins of this second coup attempt. Schiff can’t be relishing the possibility of trying to explain away his gut-buster that he doesn’t know the identity of the “whistleblower.” Lieutenant Colonel Democrat will get called back for a Leavenworth-worthy encore performance.
The biggest Democrat problem is that they will lose control of the narrative at the very time they need it most. With the inspector general report getting ready to drop and John Durham’s investigation proceeding, they simply cannot afford to turn over the megaphone.
When Republican voters are actually hoping the Democrat House votes for impeachment, the odds of an impeachment vote drop precipitously. While Democratic Party leaders are deranged, they are not that stupid.
For all of these reasons, instead of cutting the Schiffian Knot, they will likely pretend it never existed.
My guess is that they will solemnly intone that after prayerfully considering the evil president’s actions, they have decided to hold a censure vote in the interests of the country while they further investigate. They will claim they could have and probably should have impeached the president since the case was ironclad, but the Republican senators would just cover for him. With a national vote right around the corner, they will trust in the voters to deliver justice.
And then it is immediately on to the next line of attack. They have no interest in governing, which is not an altogether bad thing for America.
It’s hard to predict where that next attack will come, but it will come. Their desperate hope is that their strategy of death by a thousand cuts will eventually pay off. But with the president’s approval among black Americans now at 34%, panic must be setting in.
Perhaps they will pivot back to the Mueller report or focus on the president’s tax returns. Perhaps they will bring out the next parade of “whistleblowers,” since there is an army of them splattered throughout the federal bureaucracy like a series of sleeper cells. Perhaps they will go after the president for his Navy pardons since they have already shown that they are willing to try to impeach a president for performing his constitutional duties.
Most likely, it will be all of the above and more. Democrats and the media will do all in their power to keep the appearance of investigations alive up through the election as an offering to their restive base and as a defensive mechanism against justice, which, first and foremost, means keeping the action in the House.

GREAT VIDEO, WATCH BOTH PARTS SOLAR MINIMUM & THE SUNS MAGNETIC FIELD EFFECTS ON EARTH CLIMATE

Solar Minimum is Coming

High up in the clear blue noontime sky, the sun appears to be much the same day-in, day-out, year after year.
But astronomers have long known that this is not true. The sun does change. Properly-filtered telescopes reveal a fiery disk often speckled with dark sunspots. Sunspots are strongly magnetized, and they crackle with solar flares—magnetic explosions that illuminate Earth with flashes of X-rays and extreme ultraviolet radiation. The sun is a seething mass of activity.
Until it’s not. Every 11 years or so, sunspots fade away, bringing a period of relative calm.
“This is called solar minimum,” says Dean Pesnell of NASA’s Goddard Space Flight Center in Greenbelt, MD. “And it’s a regular part of the sunspot cycle.”
The sun is heading toward solar minimum now. Sunspot counts were relatively high in 2014, and now they are sliding toward a low point expected in 2019-2020. while intense activity such as sunspots and solar flares subside during solar minimum, that doesn’t mean the sun becomes dull. Solar activity simply changes form.
For instance, says Pesnell, “during solar minimum we can see the development of long-lived coronal holes.”
Coronal holes are vast regions in the sun’s atmosphere where the sun’s magnetic field opens up and allows streams of solar particles to escape the sun as the fast solar wind. Pesnell says “We see these holes throughout the solar cycle, but during solar minimum, they can last for a long time – six months or more.” Streams of solar wind flowing from coronal holes can cause space weather effects near Earth when they hit Earth’s magnetic field. These effects can include temporary disturbances of the Earth’s magnetosphere, called geomagnetic storms, auroras, and disruptions to communications and navigation systems.
During solar minimum, the effects of Earth’s upper atmosphere on satellites in low Earth orbit changes too.
Normally Earth’s upper atmosphere is heated and puffed up by ultraviolet radiation from the sun. Satellites in low Earth orbit experience friction as they skim through the outskirts of our atmosphere. This friction creates drag, causing satellites to lose speed over time and eventually fall back to Earth. Drag is a good thing, for space junk; natural and man-made particles floating in orbit around Earth. Drag helps keep low Earth orbit clear of debris.
But during solar minimum, this natural heating mechanism subsides. Earth’s upper atmosphere cools and, to some degree, can collapse. Without a normal amount of drag, space junk tends to hang around.
There are unique space weather effects that get stronger during solar minimum. For example, the number of galactic cosmic rays that reach Earth’s upper atmosphere increases during solar minimum. Galactic cosmic rays are high energy particles accelerated toward the solar system by distant supernova explosions and other violent events in the galaxy.
Pesnell says that “During solar minimum, the sun’s magnetic field weakens and provides less shielding from these cosmic rays. This can pose an increased threat to astronauts traveling through space.” Solar minimum brings about many changes to our sun, but less solar activity doesn’t make the sun and our space environment any less interesting.

Considering all the toxicity in the production and recycling of solar panels, how is that net-zero carbon working out?

The Toxic Pandora’s Box of Solar Panels?

The Toxic Pandora’s Box of Solar Panels?A neighbor down the street proudly placed solar panels on his house. He spent $4,000 after government subsidies and whatever deductions he may have taken from his income tax. He is confident that this move will save him tons of money on electricity and will safeguard the planet from global warming Armageddon by reducing his carbon footprint from fossil fuels.
There is one fly in this perfect ointment—solar panels generate “tons of toxic waste” during the production process and during their disposal/replacement.
The solar energy advocates, who only see cheap electricity with rose-colored glasses, are oblivious to the reality of cost, toxic chemicals, environmental pollution, and health hazards to humans and animals. Here are some immediate concerns about solar panels.
  1. How much maintenance would be required for the massive roll out of solar panels around the planet and who will pay for installation and maintenance since they do require a lot of maintenance and replacement?
  2. Solar farms and solar panels are heavily subsidized by governments. What if the subsidies stop? And they have. Solyndra went bankrupt and left taxpayers holding the bag for $535 million in federal loans. https://www.newsmax.com/FastFeatures/Barack-Obama-Solyndra-Scandal-Green-Energy/2015/01/29/id/621537/
  3. Producing crystalline silicon from silicon results in a lot of input loss. “Sawing c-Si into the thin wafers used in panels creates a significant amount of waste silicon dust, up to 50 percent of which is lost in the air and water used to rinse the wafers. The process of making crystalline silicon from silicon is also inefficient; as much as 80 percent of the raw silicon is lost in the process.
  4. Health issues in the manufacture, use, and disposal of solar panels:
    • Release of silicon tetrachloride, “a very toxic substance that reacts violently with water, causes skin burns, skin, eye, and respiratory irritations.
    • Sulfur hexafluoride, a potent greenhouse gas, 23,000 times worse than CO2, used to clean the reactors used in silicon production. In the west the “molecules are captured and reused in a closed-loop process,” but in China there is silicon tetrachloride pollution from PV cell factories established to fill the demand for solar energy.
    • Cadmium telluride (CdTe) thin films are made of cadmium, which is a toxic, expensive, cancer-causing heavy metal. Cadmium can be rinsed into the water table during the production process. One percent of CdTe is released into the environment as waste. Thin-film panels that might catch on fire in a home would release cadmium.
    • Copper indium selenide (CIS) uses hydrogen selenide which is toxic and very dangerous even in low concentrations.
    • Selenium dioxide, a dangerous air pollutant, forms at high temperatures, causing problems for manufacturing workers.
Toxic chemicals in solar panels include cadmium telluride, copper indium selenide, cadmium gallium (di)selenide, copper indium gallium (di)selenide, hexafluoroethane, lead, and polyvinyl fluoride
Dr. David Nguyen, a cancer biologist, remarked, “The toxic chemicals in solar panels include cadmium telluride, copper indium selenide, cadmium gallium (di)selenide, copper indium gallium (di)selenide, hexafluoroethane, lead, and polyvinyl fluoride. Additionally, silicon tetrachloride, a byproduct of producing crystalline silicon, is highly toxic.”
Silicon tetrachloride, the byproduct of making wafers for monocrystalline and polycrystalline panels, is highly toxic and its improper handling can cause skin burns, pollute the air, cause lung disease, and, when exposed to water it releases hydrochloric acid (HCl), a corrosive substance. Manufacturers and recyclers are directly affected and even homeowners if their homes catch on fire.
To get a picture of the environmental impact of chemicals due to solar panels manufactured and installed by 2016, a study estimates that “photovoltaics had spread about 11,000 tons of lead and about 800 tons of cadmium” into the ecosystem.
EPA has classified cadmium as a Group B1, probable human carcinogen.
There are no salvageable parts on a solar panel so it must be decomposed, and the chemicals disposed of properly. Disposal costs are exorbitant and unscrupulous. Chinese manufacturers are releasing the toxic chemicals into the environment
Carbon Footprint formed in the production, maintenance, and replacement of Solar Panels
Solar power may not produce greenhouse gases while consumers use it, but it does release harmful chemicals during production. One such chemical is nitrogen trifluoride, which, according to Ray Weiss, a professor of geochemistry at the Scripps Institution of Oceanography, is 17,000 stronger than carbon dioxide.
According to Deutsche Welle, Sulphur hexafluoride, a greenhouse gas released during solar panel production, is 22,800 times more potent than CO2.
Since 1997, when the U.S. produced 334.2 megawatts of solar energy, the industry has grown to 6,220.3 megawatts in 2013. For the 0.2 percent solar power usage in the U.S. (Institute for Energy Research), an insignificant amount, the solar panel production and disposal industries seem to create a lot of dangerous pollutants.
Ben Howell pointed out other issues that solar panel proponents have not entertained, the carbon footprint formed in the production, maintenance, and replacement of the following:
  • Batteries that store the generated electricity during the day so that the homeowner has electricity at night. If there are no batteries, then the power generated during sun light goes back into the grid and the owner must use utility power.
  • What is the carbon footprint and pollution from lithium mining?
  • What about the control switching and circuitry required by law that disconnects the home from the grid during a storm in order to avoid electrocution of utility workers from the live wires coming from the home, intermingling with the offline grid during repairs?
  • What about the backup fail-safe safety system if the primary system fails?
  • Smart meters have the lifespan of a cell phone, are very expensive to install and do not last if the traditional old electro-mechanical meters that are known to last basically forever. Ben Howell said that “the old-school electro-mechanical electric meter on my parents’ house was installed in 1948 and is still working accurately so far for 71 years.”
  • What is the cumulative cost of insurance to replace the solar panels after a hailstorm shatters the glass?
  • What is the cost to periodically clean the dust, pollen, tree sap, bird droppings, leaves, and other debris that block the sunlight from the solar panels?
  • What is the cost of a new roof or installing new shingles nailed in when the additional cost of disconnecting, off-loading, staging, up-loading, and re-installing solar panels are factored in
  • Will solar panel degradation, breakage, contamination, storms, normal clouds formations, and other anomalies, causing fluctuations in the voltage and current output cause the lithium batteries to go kaput more quickly? And will such cases void the warranty on the homeowner’s appliancE
Bill Gates’ idea to stop climate change by blocking out the sun?
Then there is the killing of massive amounts of birds that fly into the solar panels thinking that they are water pools; or they are being fried in mid-air by the powerful heat flux generated by large fields of solar panels. And, we can scarcely afford to lose thousands of acres of arable land that produces badly need food to solar panel deployment. We have lots of deserts but who is going to install and maintain them there?
And what is going to happen to solar power generation when Bill Gates will implement his idea to stop climate change by blocking out the sun? Eight specially designed jets (to be increased eventually to 100) flying 12 miles up would spray (60,000 times over 15 years) sulfate particles into the lower stratosphere to cool down our “heated” planet, block the sun, and thus interfere with photosynthesis and the production of our food which needs sunlight to grow.
Never mind that real scientists have measured a cooling of the climate as the sun is going through a solar minimum cycle.
Prompted by climate change activists and U.N. climate change propaganda organizations, students and parents in Fairfax County are organizing a climate strike in Vienna (as part of an international strike) on December 9, 2019, calling for a Green New Deal for Fairfax Public Schools to “switch all of the schools to net-zero carbon emissions by installing solar panels and energy-efficient windows. The plan would also continue the push for electric school buses in the county.”
Considering all the toxicity in the production and recycling of solar panels, how is that net-zero carbon working out? Electric school buses get their electricity from fossil fuels, natural gas, hydro, and nuclear power simply because 0.02 percent is not enough electricity generated by solar power for our huge economy. It’s that simple, teachers, students, and parents.

NATIONAL EMERGENCY? WHERE ARE THEY?

NATIONAL EMERGENCY by artist John McNaughton

NATIONAL EMERGENCYThat half of America, the poorer half most negatively affected by this crisis do not recognize the problem, is the very explanation in a nutshell why they are the poorer half!
And why they regularly vote to cut themselves off at the knees.

“National emergency? Where are they? They’re a thousand miles away!”

It also explains the difference between those who are ideologues without understanding their own ideology they never bother to question or to test the results empirically, and Americans who put the nation’s citizens first, before they put the interest of foreign nationals.
“National emergency? Where are they? They’re a thousand miles away!,” said Barack Obama on national television.
Whose flags are you waving, and whose are you stepping on?

Trump surprises troops in Afghanistan on Thanksgiving

Trump surprises troops in Afghanistan
on Thanksgiving

President Trump surprised American troops in Afghanistan on Thanksgiving after leaving his Florida residence overnight.
He visited Bagram Air Base on Thursday, delivering Thanksgiving greetings to U.S. troops deployed there in America’s longest-running war. This is Trump’s second visit to a combat zone. He previously visited troops in Iraq the day after Christmas in 2018. In the president’s address to the troops, he announced renewed peace talks between the United States and the Taliban, claiming the Taliban wants “to make a deal.”
“We’ll see if they want to make a deal,” he said. “It’s got to be a real deal, but we’ll see. But they want to make a deal. And they only want to make a deal because you are doing a great job. That is the only reason they want to make a deal. So I want to thank you and I want to thank the Afghan soldiers for — I’ve spoken to a lot of you today and you say they are really fighting hard. I was impressed with that actually. So I want to thank you.”
Trump has long wanted to withdraw from Afghanistan, and his visit coincides with the Afghan government’s engagement in an extended stalemate with the Taliban. “There is nowhere that I’d rather celebrate this Thanksgiving than right here with the toughest, strongest, best, and bravest warriors on the face of the Earth. You are indeed that,” Trump added.
He continued, “When I took office, if you can believe it almost three years ago, we were very depleted. Our military was depleted in terms of equipment. You see, right? They’re all shaking their heads. We have all those brand new planes and brand new helicopters and brand new ships being built now, brand new powerful submarines.”

AOC Owes The People of America A Public ApologyAlexandria Ocasio-Cortez owes the good people of America a huge public apology.
It was the Drama Queen, known as AOC, who openly accused President Donald Trump of “caging” immigrant children—when it was her hero ex-President Barack Obama who caged the kids all the while.
Shedding crocodile tears
AOC not only fell hook line and sinker for the progressive propaganda that the Trump administration held the record for caging immigrant children at the US border, but used it for her own self aggrandizement.
Shedding crocodile tears when she showed up at the southern border, the New York congressional freshman has referred to ICE detention facilities as “concentration camps”. link
The faux outrage of the Bernie Sanders discovered New York Rep. went viral over the Internet, where it can still be found to this day.
Alexandria Ocasio-Cortez @AOC
I’ll never forget this, because it was the moment I saw with my own eyes that the America I love was becoming a nation that steals refugee children from their parents,& caged them. More kids died after this. To date, no one has been held accountable. We need to save these kids. https://twitter.com/i_p_a_1/status/1143361683710193665

Before @AOC hit the national stage & was just a fairly unknown House candidate frm NYC,she took time awy frm her campaign & came dwn to #Tornillo to protest the #tentcity housing migrant children.I made these previously unpublished fotos a yr ago today. #elpaso #aoc #onassignment

No screaming headlines now that the caging claims against the Trump administration have been debunked. At the time of this writing only

Fox News ran the story that it was Obama and not Trump who holds the record on caged kids on its front page:
“Several media organizations were forced to make retractions Tuesday after falsely attributing a staggering Obama-era migrant child-detention statistic to President Trump. (Fox News, Nov. 19, 2019)
“On Monday, Manfred Nowak, an expert from the U.N. Global Study on Children Deprived of Liberty, claimed that 100,000 migrant children were detained by the Trump administration and indicated that it was the “world’s highest rate” of detained children. The following day, however, he acknowledged that the cited number actually was from 2015—under President Obama.
“A separate report last week from The Associated Press and the PBS series “Frontline” found 69,550 migrant children have been held in U.S. government custody in the last year.
“Nowak’s admission prompted several media outlets to withdraw their previously reported stories.
A Nov. 18 story headlined ‘U.S. has world’s highest rate of children in detention -U.N. study’ is withdrawn. The United Nations issued a statement on Nov. 19 saying the number was not current but was for the year 2015. No replacement story will be issued,” Reuters stated.
“National Public Radio wrote, “We have temporarily withdrawn this story because the study’s author has acknowledged a significant error in the data. We will post a revised article with more complete information as soon as possible.”
“Agence France-Presse (AFP), which has over 1.7 million Twitter followers, issued its own correction.
“The Associated Press offered a more detailed explanation. “The Associated Press has withdrawn its story about a claim about the number of children being held in migration-related detention in the United States. The story quoted an independent expert working with the U.N. human rights office saying that over 100,000 children are currently being held. But that figure refers to the total number of U.S. child detentions for the year 2015, according to the U.N. refugee agency.”
“Many outlets had run with The Associated Press’s inaccurate report, including NBC News. Al Jazeera also issued an “update.”
“Some Democrats initially seized on the inaccurate reporting, including the DNC War Room and 2020 presidential candidate Sen. Bernie Sanders, I-Vt., who have since deleted their tweets.
“This is a disgusting result of Trump’s family separation policies- pushed by Stephen Miller who has cited white nationalist propaganda in promoting his views. It’s also, apparently, a violation of a U.N. treaty, the Convention on the Rights of the Child,” the DNC War Room initially wrote, unaware that it was slamming the Obama administration.
“Sanders offered a multiple-choice question, “What country has the world’s highest rate of child detention,” which had Botswana, Sri Lanka, and Mexico as alternative options.
“Under Trump, America leads the world in locking up little kids- including 100,000 children at the border. This is immoral,” Sanders wrote in the now-deleted tweet.
“Donald Trump Jr. blasted the media, suggesting they were selective at what stories they retracted.
“I guess they’ll only withdraw true stories that make Obama look bad rather than leaving up the truth for everyone to see? This is why no one trusts the media,” Trump Jr. wrote.
“The White House did not immediately respond to Fox News’ request for comment.”
Meanwhile, Lie-Spreader Ocasio-Cortez, who now works for Tweet Delete King Bernie Sanders, and who raked in $1.42M in the third quarter, topping both Pelosi and Schiff, skates free in The Sordid world of Progressive Propaganda.

Brennan And Clapper’s Secret Surveillance System

Brennan And Clapper’s Secret Surveillance System

By |November 19th, 2019
Kelleigh Nelson
Every time we witness an injustice and do not act, we train our character to be passive in its presence and thereby eventually lose all ability to defend ourselves and those we love. —Julian Assange
Every person remembers some moment in their life where they witnessed some injustice, big or small, and looked away because the consequences of intervening seemed too intimidating. But there’s a limit to the amount of incivility and inequality and inhumanity that each individual can tolerate. I crossed that line. And I’m no longer alone. —Edward Snowden
When injustice becomes law, resistance become duty. —Thomas Jefferson
There may be times when we are powerless to prevent injustice, but there must never be a time when we fail to protest. —Elie Wiesel
The following information has been gathered from countless articles by Mary Fanning and Alan Jones of theAmericanreport.org. Their reports should be read by every American, including our nation’s politicians.
Dennis Montgomery is a software designer and former CIA/NSA/DoD/DHS contractor. Montgomery built a surveillance system known as “The Hammer.” He blew the whistle on the Obama administration’s allegedly illegal use of that system to wiretap Donald Trump. (Rand Paul claims Brennan, Clapper, Comey sent spies into the Trump campaign.)
Montgomery also developed technology for analyzing surveillance video from U.S. Air Force predator drones remotely piloted from Nellis Air Force Base in Nevada. Nellis Air Force Base is also the home of a charter school run by imam Fethullah Gulen. Clinton’s hand-picked CIA handlers, Graham Fuller and Mark Grossman, were selected to manage and direct Gulen’s cells in the U.S. and abroad. Link
Reminiscent of the theft of Bill Hamilton’s Inslaw Promis software allegedly by the Reagan administration’s Ed Meese, this is much the same thing. The government seems to steal from private enterprises what they want for their own.
Montgomery asserts that intelligence officials John Brennan and James Clapper ran “The Hammer” surveillance system. According to CIA Vault 7 documents released by WikiLeaks on March 7, 2017, The Hammer (HAMR) is a browser exploit throwing framework that infects targeted devices and systems. The Hammer allowed spying on Supreme Court Justices, 159 Article III judges, elected officials, and 20 million other Americans.

Mainstream Media Coverup

CNN’s reporting indicates that CNN and The Washington Post were engaging in a multi-prong strategy to cover up the Obama administration’s illegal surveillance of Trump, including the participation of John Brennan, James Clapper, and Carl Bernstein. CNN and the Washington Post continue to ignore the fact that Montgomery turned over evidence to the FBI.
Testimony from former FBI General Counsel James Baker asserts the FBI took possession of evidence that proves that the Obama administration wiretapped Trump. They ignored Montgomery’s claim. James Baker asserted that, “An individual named Dennis Montgomery, who I believe, to the best of my recollection, said that he had been a U.S. Government contractor and, in the course of that work, had come across evidence of unlawful surveillance by the government, of Americans including government officials and wanted to give that information to the Bureau, which eventually did take place.”
Remember Bernstein told everything on Nixon, but he was silent on the illegal wiretapping of Donald Trump. Obama’s surveillance hammer on Trump is far worse than Watergate. Lt. General Thomas McInerney (Ret.), formerly the number three Air Force official at the Pentagon, also said “The Hammer” surveillance system is far worse than Watergate.
Only two days before he died, Admiral James A. “Ace” Lyons (Ret.), who served as commander of the U.S. Navy Pacific Fleet, appeared less concerned about dying than about countering the coup against President Trump. Admiral Lyons was convinced that the coup was put in motion to cover up “The Hammer” and the actions of the men behind it. Admiral Lyons was a great patriot, and spot on in his reporting. Link

The D.C. Conspiracy

There is a conspiracy underway deep within the Washington D.C. intelligence and law enforcement establishments. The cabal should have much to fear, but as of yet, not one DOJ criminal has been indicted. U.S. Attorney John Durham is reportedly very interested in interviewing President Obama’s former intelligence chiefs, ex-CIA Director John Brennan and one-time Director of National Intelligence James Clapper. I would hope that happens, but as of yet, those two men are still walking free.
In 2015, contractor-turned whistleblower Dennis Montgomery provided the FBI with 47 computer hard drives of illicitly-harvested domestic surveillance data and classified testimony that, according to Montgomery, proves Brennan and Clapper illegally commandeered the foreign surveillance tool known as “The Hammer.”
Montgomery contends Brennan and Clapper used “The Hammer” to conduct unlawful domestic surveillance on President Obama’s political enemies for the purpose of “blackmail” and “leverage.”
Soviet Style Surveillance
Brennan and Clapper built a Soviet style total surveillance state modeled after the Stasi of East Germany. They did it by commandeering “The Hammer” for domestic surveillance, with greater tech capability for total control of the people. They must long to turn America into Soviet Russia.

According to Montgomery, Brennan and Clapper used “The Hammer” to illegally wiretap Lt. General Michael Flynn (Ret.) and Donald Trump. Oh yes, the leaders of the coup, Obama, Brennan, and Comey all have professed their allegiance to Marxism and communism at various points in their lives. See The Red Thread by Diana West.

AG Barr and U.S. Attorney Durham recently traveled to Rome, Italy, where Durham reportedly retrieved two BlackBerry smartphones that were previously used by Joseph Mifsud. The public really didn’t understand the significance of the retrieval. Special Counsel Mueller’s investigation portrayed Mifsud as a Russian agent. Mifsud is actually an FBI asset. According to Dennis Montgomery, when the BlackBerry phones are used on “The Hammer” platform they are a closed secret network that is encrypted and secure and cannot be penetrated.
It is of interest that Mifsud, Hillary, Comey, President Obama and others were using BlackBerry phones. How many others inside the Crossfire Hurricane covert FBI operation against Trump were plotting the coup d’état while also using non-government issued BlackBerry phones? Two of Hillary’s BlackBerrys were destroyed by Clinton Foundation advisor, Justin Cooper.
Despite the fact there was no criminal reason, the Obama administration used its counterintelligence powers to investigate the opposition party’s presidential campaign.

The Fusion Center

Brennan concocted the Trump-Russia intelligence “Fusion Center” narrative as a cover story because Brennan and Clapper had illegally commandeered “The Hammer” for illegal domestic surveillance and for wiretapping Trump, in violation of the CIA’s Charter. Fusion Center is a collaborative effort between two or more agencies.
Back in August of 2018, Brennan told Rachel Maddow, “We put together a Fusion Center at CIA that brought NSA and FBI officers together with CIA to make sure that those proverbial dots would be connected.” He never mentioned that each of these intel agencies have separate charters and for good reason.
Whistleblower Montgomery says that on February 3, 2009, Brennan and Clapper got together to commandeer The Hammer for illicit purposes. Montgomery designed and built the supercomputer, just as Inslaw owner Bill Hamilton designed Promis software. The supercomputer system had served as a foreign surveillance tool and was transferred from Blxware in Washington state to a CIA facility in Ft. Washington, Maryland. There, Brennan and Clapper transformed The Hammer into a surveillance tool to target Obama’s political enemies.
According to Military sources, the supercomputer has multiple safeguards to prevent intel personnel from using the system for unlawful domestic surveillance, but Brennan and Clapper bypassed those safeguards. They set up a more powerful system and illegally re-purposed the computer.

Targeting Trump

Brennan and Clapper allegedly spied on Chief Justice John Roberts, Justice Scalia, onetime head of the Foreign Intelligence Surveillance Court (FISA) Judge Reggie Walton, 156 Article III Judgesmembers of Congress, Rudy Giuliani, General Michael Flynn (Ret.), and Donald Trump.
General Michael Flynn’s attorney Sidney Powell says several former officials who were involved in the CIA /FBI Crossfire Hurricane operation are in ongoing talks with Justice Department officials.

The Whistleblower tapes released by U.S. District Judge G. Murray Snow, revealed that President Obama’s intelligence officials, Brennan and Clapper, for whom Montgomery was working, used the spyware for unlawful domestic surveillance and to illegally wiretap Donald Trump “a zillion times.”

President Trump’s allegation that the Obama Administration was wiretapping him is not only supported by Montgomery’s whistleblower revelations about Brennan’s and Clapper’s computer system, The Hammer, but also by statements made in March 2017 by whistleblower William Binney, a former NSA Technical Director of the World Geopolitical and Military Analysis Reporting Group, by former CIA and State Department official Larry Johnson, and by Montgomery’s attorney Larry Klayman.

FBI Director Mueller

Montgomery says it was Robert Mueller’s FBI who provided the computers for The Hammer, and who also ordered an illegal FBI raid of Montgomery’s home and storage facility. Mueller’s FBI agents tied Montgomery to a tree, according to court documents.
U.S. Magistrate Judge Valerie Cooke excoriated the FBI for using falsified affidavits to obtain search warrants and forced the return of Montgomery’s property. Obviously, the FBI hasn’t changed its stripes since they continue to operate in a rogue and illicit fashion, even under AG William Barr and Deep State FBI Director Christopher Wray.
Mueller became, by appointment of Rod Rosenstein, and because of his close friend, James Comey, the Special Counsel investigator of the Russia collusion hoax. Montgomery claimed that Robert Mueller had been collecting information on Donald Trump for over ten years and he was the last person anyone should appoint to investigate the President and the phony Russian Collusion hoax.
The day before Robert Mueller was appointed as Special Counsel, he had interviewed with Donald Trump to once again become the Director of the FBI and was obviously rejected, and for good reason.
FBI Director Mueller wanted to use The Hammer to find out “who knew what” about the 9/11 terror attacks on New York City and Washington D.C. Mueller was in charge of the FBI’s investigation of the 9/11 attacks. John Milkovich’s book, Robert Mueller: Errand Boy for the New World Order, tells of Mueller’s several coverups regarding the 9/11 terror attacks. Interestingly, Mr. Trump, as a builder of skyscrapers, took a special interest in the collapse of the twin towers.

Dennis Montgomery

Dennis Montgomery became a target of the government and the media who worked to destroy his reputation. Ultimately, he suffered a stroke. He had filed 18 whistleblower complaints. In D.C., Montgomery testified to DOJ’s Deborah Curtis regarding the 47 hard drives of The Hammer that contained illicitly collected domestic surveillance data, evidence that Comey buried after being turned in to Comey’s FBI.
Mary Fanning and Alan Jones write, “Assistant U.S. Attorney Deborah Curtis offered Dennis Montgomery limited immunity in exchange for 47 hard drives of illegally harvested surveillance data that Montgomery claims contains proof that Brennan and Clapper wiretapped General Flynn and Donald Trump. (This immunity was in coordination with FBI General Counsel James Baker.) Then Curtis joined Special Counsel Mueller’s team and became the lead prosecutor on General Flynn’s case before abruptly leaving the Flynn prosecution and the DOJ.”
James Baker is suspected of leaking the discredited Steele dossier to Mother Jones reporter David Corn. Baker was also part of the group that plotted the take-down of General Flynn and President Trump.
Montgomery asserts the hard drives have information that not only proves Brennan and Clapper wiretapped General Flynn but also provides proof that the DOJ conducted illegal prosecutions of President Obama’s political enemies.
Baker later joined the Brookings Institution and its affiliate Lawfare, which acts as the political arm of the FBI and the intelligence community. Link

Conclusion

Invented lies and corrupt actions of high officials who have abused the power of their positions for political gain must be exposed and punished. They have sought to subvert our rules of law and undermine the Republic. They have damaged and are still damaging the institutions of American government, all the while squandering the nation’s trust.

THE ISSUES OF QUID PRO JOE ARE MANY!

Quid Pro Joe’s conflicts of interest FAR deeper than previously reported

STEVE GUEST – November 6, 2019

The vast conflicts of interest stemming from Joe Biden’s family’s business interests are FAR deeper than previously reported.
Josh Dawsey @jdawsey1
“A little help from the vice president:” How Joe Biden, his younger brother Frank, a lobbyist and an oil heiress got Congress to ban the slaughter of horses for meat: https://www.politico.com/news/2019/11/06/joe-biden-frank-biden-horse-meat-ban-066394
Politico’s report on the lobbying efforts Joe Biden’s younger brother Frank conducted highlights the “decades-long pattern in which the private business dealings of Joe Biden’s relatives have overlapped with Biden’s public duties.”
Ben Schreckinger @SchreckReports
As vice president, Joe Biden went to great lengths to secure the passage of a measure banning the slaughter of horses for meat. The measure’s top advocates — an oil heiress and her lobbyist — were close associates of Biden’s younger brother https://www.politico.com/news/2019/11/06/joe-biden-frank-biden-horse-meat-ban-066394
Politico found that while Joe Biden now denies “taking official actions to benefit his relatives… interviews, public records, emails, and video reviewed by POLITICO tell a different story — one in which the vice president went to great lengths to secure a measure sought by a lobbyist who was a close associate of his brother.”
And Politico has caught Frank Biden and his business associates repeatedly changing their stories when confronted by reporters. From Frank Biden’s business partner saying, “We may need a little help from the vice president and the administration talking to some senators” to Frank bragging on video that “My brother’s long-term relationships in the Senate proved to be the final nail in the coffin to be able to pull this thing forward” to Frank telling a school board “I give you my word of honor on my family name that this system is sustainable,” Frank’s business dealings were inseparable from his brother’s position as Vice President.

Alex Thompson @AlxThomp

CHRIS STIREWALT – HALF TIME REPORT

Fox News Halftime Report

Nov. 26, 2019
By Chris Stirewalt

On the roster: Bernie, Warren, Buttigieg, Biden knotted in N.H. – Detroit Democrat does impeachment flip-flop-flip – Audible: How it’s done – The car that caught the dog

BERNIE, WARREN, BUTTIGIEG, BIDEN KNOTTED IN N.H.
Boston Globe: “A new Suffolk University/Boston Globe poll of likely New Hampshire Democratic primary voters shows a tight, four-way contest, with Senator Bernie Sanders of Vermont on top but statistically tied with Senator Elizabeth Warren of Massachusetts, Mayor Pete Buttigieg of South Bend, Ind., and former vice president Joe Biden. It has been decades since this many candidates have jostled for the lead so soon before a New Hampshire presidential primary. On Monday, longtime New Hampshire Secretary of State Bill Gardner officially scheduled the vote for Feb. 11. The survey found Sanders, who won the New Hampshire primary in 2016, leading the field with 16 percent, including those who lean toward the candidate. Warren had 14 percent, Buttigieg had 13 percent, and Biden had 12 percent. All other candidates, including former Massachusetts governor Deval Patrick, who jumped in the race this month, were in single digits. The poll suggested little about this race is set in stone.”

Senior Biden staffer, Latina adviser quits campaign – Politico: “A senior Joe Biden campaign staffer in charge of outreach to Latino, African-American and women’s groups has quit her post, telling two allies she was frustrated over her lack of input and with the presidential candidate’s immigration rhetoric. Vanessa Cárdenas, the most senior Latina Biden staffer, had been serving as national coalitions director since the campaign formally announced its existence April 25. She resigned last week and has since changed her bio on Twitter to say she was ‘formerly with @joebiden.’ Cárdenas did not return a call or text message, but two friends familiar with her thinking told POLITICO that she felt the campaign wasn’t heeding her advice on immigration as she tried to reach out to Latino groups that have had longstanding concerns with the former vice president’s rhetoric and record stemming from the Obama administration.”

Bloomy’s low-key, high-dollar launch – NYT: “Michael R. Bloomberg started his campaign at a hushed diner in downtown Norfolk, Va. … before strolling to a nearby hotel ballroom and making an efficient statement before a bank of television cameras. Accompanied by a small platoon of aides, including two of his former deputy mayors from New York City and a security team that flitted around a downtown waterfront nearly barren of pedestrians, Mr. Bloomberg described himself as a political pragmatist skilled at wielding his wealth to win elections. … If Mr. Bloomberg’s first in-person appearance as a presidential candidate lacked something in organic political energy, he has already jolted the race through the sheer scale of his political spending, stunning the Democratic political establishment and stirring an outcry from the party’s populist wing.”

Deval Patrick has a long way to go – Politico: “To call Deval Patrick’s campaign a shoestring operation would be insulting to shoestrings. Attend a Patrick event and there’s not a bumper sticker or pin to be found, let alone organizers with clipboards collecting names of would-be voters. His ground game looks to be nonexistent: The entire campaign appears to consist of a handful of volunteers and one publicly announced staffer, campaign manager Abe Rakov. In comparison, other campaigns have several hundred paid staffers and dozens of offices combined — and that’s just in New Hampshire. Patrick has spent the first dozen days of his campaign trying to persuade senior Democratic leaders in the early voting states to take him seriously. They want to give the former Massachusetts governor with an inspirational life story and friendship with Barack Obama the benefit of the doubt. But Patrick has a way to go before they fully buy in.”

Ryan Lizza: Waiting for Obama – Politico: “The post-presidency of Obama is unlike any other. Many presidents have had to navigate the tricky politics of leaving office when a president from the other party takes over. And plenty of presidents have had to grapple with the delicate situation of their vice president seeking a promotion. But Obama has to grapple with both situations simultaneously, and under unprecedented conditions: Obama is under near daily personal assault from the president, who has tweeted about him relentlessly in the past three years, often accusing him and his top officials of an array of crimes, a situation that no ex-president has faced or even imagined.”

THE RULEBOOK: IT’S IN THE DETAILS
“THE erection of a new government, whatever care or wisdom may distinguish the work, cannot fail to originate questions of intricacy and nicety; and these may, in a particular manner, be expected to flow from the establishment of a constitution founded upon the total or partial incorporation of a number of distinct sovereignties.” – Alexander Hamilton, Federalist No. 82

“The Constitutional Grounds for Presidential Impeachment” Scheduled December 4th.

Judiciary impeachment hearing set for Dec. 4

Behind Judiciary Chairman Jerrold Nadler (D-N.Y.), the committee will hear from legal scholars as Democrats weigh whether the evidence turned up in their weeks-long impeachment inquiry warrants the drafting of articles aimed at removing the president from office.
The hearing — entitled “the constitutional grounds for presidential impeachment” — is the first in the third phase of the investigation into whether Trump abused his powers in pressing Ukrainian leaders to find dirt on his political opponents.
Ahead of the hearing, Nadler wrote to Trump requesting his participation — or that of White House counsel — as part of ensuring “a fair and informative process.”
The Dec. 4 hearing follows a series of closed-door depositions — conducted by the Intelligence, Oversight and Foreign Affairs committees — with 17 diplomats and national security officials with insights into Trump’s handling of foreign policy in Kyiv. It follows a series of closed-door depositions — conducted by the Intelligence, Oversight and Foreign Affairs committees — with 17 diplomats and national security officials with insights into Trump’s handling of foreign policy in Kyiv.
That was followed by pubic hearings with 12 of those witnesses before the Intelligence Committee. Behind Intelligence Chairman Adam Schiff (D-Calif.), impeachment investigators are drafting a report to be delivered to Nadler and the Judiciary panel, which must decide if Trump’s conduct is impeachable.

Did Trump Critic Rep. Rashida Tlaib Violate Campaign Finance Laws and Ethics Rules?

GianCarlo Canaparo / Hans von Spakovsky / / 20 Comments

“It’s pretty simple,” Rep. Rashida Tlaib, D-Mich., tweeted last March, in calling for President Donald Trump’s impeachment. “No one is above the law, including the President of the United States.” But perhaps Tlaib—among Trump’s harshest critics in Congress—needs to follow up with another tweet, in the interests of transparency. This tweet could read: “No one is above the law. Except me.”
According to a report issued last week by the House Ethics Committee, there is “substantial reason to believe” that Tlaib used campaign funds for personal expenditures, thereby violating both campaign finance laws and House ethics rules. The alleged violations stem from $17,500 that her campaign paid her, apparently to cover personal expenses, after she was elected to Congress.
Text messages and emails between Tlaib and her campaign staff show that throughout her campaign she repeatedly asked her campaign for money to cover personal expenses like “car maintenance, child care, and other necessities.” At one point, Tlaib asked her campaign to give her $2,000 every two weeks. Between May 7 and Nov. 16, 2018, it did so. Then, on Dec. 1, 2018, it paid her $15,500.
In total, Tlaib’s campaign gave her $45,000 over seven months.
Federal campaign finance law (52 U.S.C. §30114(b)) prohibits the use of campaign funds for personal use. The law, including the regulations promulgated by the Federal Election Commission, defines “personal use” very broadly. Personal use includes any “commitment, obligation, or expense of a person that would exist irrespective of the candidate’s campaign duties.” That plainly includes car maintenance, child care, and “other necessities.”
Additionally, House ethics rules prohibit representatives from using campaign funds for personal expenditures. They and their staffs are tasked with ensuring that their campaigns operate in compliance with the law. While candidates may take a salary from their campaigns, there are very strict limits on that. Among the litany of restrictions is this one: The salary can only be paid for work performed before the election. The salary has to end the day the candidate is either elected or withdraws from the race and is no longer a candidate.
Tlaib’s eligibility for a salary paid from her campaign funds ended on Nov. 6, 2018, when she was elected to the House of Representatives. Yet her campaign continued to pay her through the end of December. She collected $17,500 after the election. Tlaib’s lawyers concede that the payments were made after Nov. 6 last year, but argue that the money was for services performed before the election. But according to the report, documents taken from her campaign “suggest otherwise.”
A spreadsheet of campaign salary payments shows that Tlaib’s campaign paid her $2,000 on Nov. 16 last year for work performed between Nov. 1 and 15. And according to that same spreadsheet, the $15,500 paid on Dec. 1 was for work performed between Nov. 16 and Dec. 31 last year. Additionally, the checks confirm those dates, as do emails from Tlaib’s campaign treasurer. As to the $15,500 payment, her campaign treasurer’s records show that at least $8,000 of it was paid for work performed after the election, and the remaining $7,500 was an unspecified “adjustment.”
It certainly appears to be a clear violation of federal law. Perhaps it’s no surprise, then, that the best arguments her lawyers can come up with are that there was no “conscious disregard” of the law, and that it’s “most irregular” for the Office of Congressional Ethics to look into pre-election activities. In other words, Tlaib should be excused because she didn’t bother to learn the law or because Congress should permit candidates to violate ethics laws with impunity until they get elected. It doesn’t take a lawyer to see how feeble these arguments are.
Given how bad this looks for Tlaib, it’s no surprise that she and her campaign staff refused all interview requests from the Office of Congressional Ethics.
And Tlaib’s problems extend beyond the Ethics Committee.
Both the Federal Election Commission and the U.S. Justice Department have jurisdiction over violations of federal campaign finance law. The FEC can force those who err to repay the money and impose a civil penalty – even where there was no “conscious disregard” of the law.
If Tlaib “knowingly and willfully” violated the law, that is a criminal violation that comes under the jurisdiction of the Justice Department. Criminal violations of the law can result not only in civil penalties, but prison time.
We agree with Tlaib that “no one is above the law.” Does she agree with her own tweet?

“It Should Be Fun.” Nunes Doubles Down on Suing CNN & Daily Beast

“It Should Be Fun.” Nunes Doubles Down on Suing CNN & Daily Beast

Representative Devin Nunes (R-Calif.) reiterated his pledge to sue CNN and the Daily Beast during an interview on Fox News’s Sunday Morning Featuressaying that the way to hold “corrupt” media outlets accountable is to take them to federal court.
Nunes announced his intention to take legal action on Friday after both the Daily Beast and CNN published stories that claim the ranking member of the House Intelligence Committee met with former Ukrainian prosecutor Victor Shokin in Vienna in 2018 to pursue an investigation into Joe Biden and his son, Hunter.
Shokin was fired as prosecutor general of Ukraine in 2016 after then-U.S. Vice President Joe Biden threatened Ukrainian President Petro Poroshenko that America would hold back $1 billion in loan guarantees unless he removed Shokin — who was then investigating the natural gas company Bursima Holdings, at which Hunter Biden was a board member making $50,000 a month.
President Trump’s request that current Ukrainian President Volodymyr Zelensky “look into” the matter forms the basis of Democrat’s impeachment effort in the House of Representatives.
The Daily Beast and CNN stories cite as their source Lev Parnas, a business associate of Trump attorney and former New York Mayor Rudy Giuliani who was indicted in October for conspiring to ban federal election rules against foreign donations.
The fact that the outlets cited an individual under federal indictment prompted Nunes to question the validity of the source.

I’ve been used to this for the last three years,” Nunes told Fox News. “The House Intelligence Committee Republicans, we continue to expose Democrat corruption over and over again. And what always happens is right when we expose them… they go out to kill the messenger.”The Republican lawmaker continued: “So this week — another fake news story. The problem with this week’s fake news story is — we actually caught them. And we caught them badly and it also involves criminal activity…. We are going to take both CNN and the Daily Beast likely into federal court, right after Thanksgiving and we hope they cooperate.”

The Daily Beast first reported on the alleged meeting on Thursday, citing Parnas’ lawyer Ed MacMahon. The Beast also claimed to have seen travel records that allegedly show Nunes and three of his aides traveled to Europe from November 30 to December 3, 2018.
“Nunes aide Derek Harvey participated in the meetings, the lawyer said, which were arranged to help Nunes’ investigative work. MacMahon didn’t specify what those investigations entailed,” the Daily Beast article read. CNN seconded the Daily Beast’s claims with a Saturday article that cited Parnas’ other lawyer, Joseph A. Bondy, who said Nunes contacted officials who would help him find dirt on the Bidens.
“Mr. Parnas learned from former Ukrainian Prosecutor General Victor Shokin that Nunes had met with Shokin in Vienna last December,” CNN quoted Bondy as saying.
In a statement to Breitbart, Nunes called CNN’s report “demonstrably false.”
His statement added:
Some political operative offered these fake stories to at least five different media outlets before finding someone irresponsible enough to publish them. I look forward to prosecuting these cases, including the media outlets, as well as the sources of their fake stories, to the fullest extent of the law. I intend to hold the Daily Beast and CNN accountable for their actions. They will find themselves in court soon after Thanksgiving.
Nunes went on to tell Fox News that CNN and the Daily Beast “should comply with the subpoenas once we file this and go through different depositions. It should be fun.”
He maintained that the outlets “very likely” committed a crime or were “an accessory to it,” emphasizing that “none of this is true…. We will get to all the facts when it’s filed in court. But somehow they’re either witting or unwitting of listening to somebody who’s been indicted and not only that, but it’s their lawyers.
“So you’re talking about third and fourth hand hearsay to do what? To dirty up the leader of the Republicans on the Intelligence Committee that just destroyed their complete narrative that they’ve been pushing.” Nunes has been a fierce critic of the impeachment inquiry playing out in the House, accusing Democrats of harboring “Watergate fantasies.” “In their mania to attack the President, no conspiracy theory is too outlandish for the Democrats,” Nunes said before a witness testimony on Wednesday.

Bloomberg Officially Announces His Candidacy for President

Bloomberg Officially Announces His Candidacy for President

Former New York City Mayor Michael Bloomberg officially announced his candidacy on Sunday, declaring on his newly-minted website:
I’m running for president to defeat Donald Trump and rebuild America.
We cannot afford four more years of President Trump’s reckless and unethical actions. He represents an existential threat to our country and our values. If he wins another term in office, we may never recover from the damage. This is Bloomberg’s strategy: Ignore the other Democrat candidates vying for their party’s nomination and instead focus on the president and his alleged failures.
According to Bloomberg,
We have an economy that is tilted against most Americans.
We have a health care system that costs too much and doesn’t cover everyone.
We have communities ravaged by gun violence….
We have a climate crisis that is growing worse by the day.
We have special interests that corrupt Washington and block progress on all of these issues.
To be certain that no one reading his letter misses the point, he added, “Defeating Trump — and rebuilding America — is the most urgent and important fight of our lives. And I’m going all in.
He ends by promising something for everyone:
Creating good-paying jobs
Providing quality health care for every American
Stopping gun violence
Fighting climate change
Fixing our broken immigration system
Raising taxes on wealthy individuals like me
Protecting women’s and LGBTQ rights
Supporting our veterans
Reestablishing America’s place in the world as a force for peace and stability
And just how does he propose to do this? By spending money. Lots of money. He’s rejecting any outside contributions and funding his campaign alone. This week, for example, he has already committed $37 million to buying 60-second TV spots in 100 markets in 29 states. He has committed $100 million to a campaign focused on criticizing the president in key battleground states, and another $15 million to voter registration efforts in those key states.
He’s skipping the debates. Instead he is focusing on March 3, 2020 — Super Tuesday — when 16 states hold their primaries or caucuses, commanding 1,345 Democrat Party delegates. He is narrowing his focus primarily on Texas and California, which offer the tantalizing total of 642 delegates, or about half the total. If he succeeds, this sets the table nicely for a run for the Democrat Party’s nomination, a result never before accomplished this way in history.
The New York Times doubts that Bloomberg will be successful despite his $100-million-plus effort: “It is highly uncertain whether groups [such as minority voters and less affluent whites] will see a 77-year-old billionaire as a compelling alternative to Mr. Biden who is a far more familiar figure campaigning on similar themes.”
He is counting on his relative anonymity for an advantage as a “surprise contender” and a “new choice” for Democrats still looking for someone with the moxie and the bare knuckles to take on the president next November.
History is not on Bloomberg’s side. If somehow he won the Democrat Party’s nomination, and then beat Trump in November, he would be the oldest person ever to assume the presidency. And he would be the first Jewish president.
History is littered with the detritus of failed campaigns that tried to pull off this sort of end run. And his “favorability” numbers among Democrats, as The New American pointed out, are worst-in-the-field.
At present, he is all but invisible in the polls. In the last four polls taken between November 11 and November 20, Bloomberg captured three percent in two of them, one percent in another, and no-showed in the fourth, for an average of 2.3 percent. In the Real Clear Politics summary, Biden retains a firm grasp on first position, at 30 percent, with Sanders and Warren a full 10 points behind.
But with the millions Bloomberg is poised to spend, he could move the needle a little bit, in favor of Warren or Sanders. With Biden perceived as a “moderate” — a position Bloomberg is promoting for himself — the former New York City mayor could siphon off just enough support from Biden (perceived increasingly as stumbling and often incoherent on the hustings) to hand the party’s nomination either to Warren or Sanders.
The president would no doubt relish the opportunity to face off against either of these far-out socialists.
